Conditions of Sale
All property is sold “as is,” and neither the auctioneer nor any consignor makes any warranties or representation of any kind or nature with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, of description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property and no statement made at the sale, or in the bill of sale, or invoice or elsewhere shall be deemed such a warranty of representation or an assumption of liability.
The highest bidder as determined by Bettina Network, Inc. shall be the purchaser. In the case of a disputed bid, the Bettina Network, Inc. shall have sole discretion in determining the purchaser and may also, at its sole discretion, withdraw the lot or re-offer the lot for sale.
Bettina Network, Inc. shall have sole discretion to refuse any bid. Any bidder planning on spending in excess of $50,000 should make arrangements with the Bettina Network's accounting department at least five (5) days in advance of the sale, as--in some cases--a deposit may be required to participate.
Payment & Removal
All merchandise purchased must be paid for and removed from the premises the day the sale ends, unless the purchaser has made prior arrangements with Bettina Network, Inc. either to remove the items at another time or has requested Bettina Network, Inc. arrange for packing and shipping of their purchases.
Bettina Network, Inc. may impose, and the purchaser agrees to pay, a monthly interest charge of 1.5% of the purchase price of any lot or portion of a lot not paid for within ten (10) days of the date of sale.
Bettina Network, Inc. shall have no liability for any damage or loss to property left on the sale premises once the sale has ended. If any property has not been removed by the date specified with each sale and the new owner has not made other arrangements with Bettina Network, Inc., at the option of Bettina Network, Inc., it may impose, and the purchaser agrees to pay, a monthly storage charge of 1.5% of the purchase price of any lot or portion of a lot not removed within the time frame specified with the particular sale in which the item was purchased, and/or Bettina Network, Inc. may place the merchandise in a subsequent sale, without Reserve, to be sold to the highest bidder, and after deducting the standard commission and any additional charges that may apply, remit the proceeds to the purchaser.
Methods of Payment
Bettina Network, Inc. accepts cash, credit cards (i.e., American Express, MasterCard, Visa, Diners Club, Discover) as well as checks for payment.
Personal checks will be acceptable only if credit has been established with Bettina Network, Inc. or if a bank authorization has been received guaranteeing a check. Bettina Network, Inc. reserves the right to hold merchandise purchased by check until said check has cleared the bank. The purchaser agrees to pay Bettina Network, Inc. a handling charge of $25.00 for any check dishonored by the drawee. Please contact Bettina Network, Inc. for additional payment methods.
Shipping is the responsibility of the purchaser. However, upon request, our staff will either have the item or items packed and shipped in consultation with the new owners of the item or items or will provide the new owners with a list of shippers who deliver to destinations within the United States and overseas. If Bettina Network, Inc. arranges for the item or items to be shipped, Bettina Network, Inc. will do its best to make sure the best possible shipper and treatment of the item or items occurs, but will not take responsibility for the shipment. Responsibility for the shipment will lie with the shipper and the new owner of the item or items. Some property that is sold can be subject to laws governing export from the U.S., such as items that include material from some endangered species. Import restrictions from foreign countries are subject to these same governing laws. Granting of licensing for import or export of goods from local authorities is the sole responsibility of the buyer. Denial or delay of licensing will not constitute cancellation or delay in payment for the total purchase price of these lots.
The sales slip you receive with your purchases clearly states that the merchandise is purchased “as is” and there is no refund or exchange of any kind. Once your bid is submitted you are liable for payment without any return policy. The purchaser acknowledges that in making payments to Bettina Network, Inc. to cover the cost of their purchases, when said payments are made by credit card or other credit instrument those payments have a no return, no refund, no reduced amount for goods with damages the goods may have acquired over the years, etc. policy attached, as do payments made via cash or via any other method of payment. It is the buyer's responsibility to examine the merchandise before it is purchased, because there is no accommodation that will be made if you find defects or are dissatisfied with your purchase in any way. If you are a purchaser living in another city, state, country, you may ask someone you know in the location where the sale is being held to examine the items or items for you. Bettina Network, Inc. gives complete and true descriptions of the lots it sells and takes care to give you a picture and in some cases a video for a more complete view of the item or items. That is the extent of Bettina Network, Inc.'s responsibility as to condition. If you would like to talk to someone at Bettina Network, Inc. about the condition of the item(s) before you purchase same, there is always someone available to discuss the item or item's condition with you. The ultimate decision whether or not to purchase is with the buyer and nothing anyone affiliated with Bettina Network, Inc. says changes that responsibility. The discussion on condition is simply an aid to attempt to clarify questions the purchaser may have. Any such discussion with anyone affiliated with Bettina Network, Inc. does not change the fact that no accommodation will be made after purchase of an item or items, nor will any discussion the purchaser may have had with Bettina Network, Inc. move the responsibility for knowing the condition of an item or items away from the purchaser.
If the purchaser breaches any of its obligations under these Conditions of Sale, including its obligation to pay in full the purchase price of all items for which it was the highest successful bidder, Bettina Network, Inc. may exercise all of its rights and remedies under the law including, without limitation, (a) canceling the sale and applying any payments made by the purchaser to the damages caused by the purchaser’s breach, and/or (b) offering at the next sale, without reserve, any lot or item for which the purchaser has breached any of its obligations, including its obligation to pay in full the purchase price, holding the purchaser liable for any deficiency plus all costs of sale.
In no event will the liability of Bettina Network, Inc. to any purchaser with respect to any item exceed the purchase price actually paid by such purchaser for such item.
Bidding on any item indicates your acceptance of these terms and all other terms announced at the time of sale whether bidding in person, through a representative, by phone, by Internet, or other absentee bid.
Bettina Network, Inc. and the owners of the property being sold make no warranty or representation, express or implied, that the purchaser will acquire any copyright or reproduction rights to any lot sold.
Bettina Network, Inc. expressly reserves the right to reproduce any image of the lots sold in this sale, including the right to add the item or items sold to Bettina's Research Library and make those images and the price at which the item or items were sold available to those who subscribe to Bettina's Research Library in an effort to maintain the provenance for items sold through Bettina Network, Inc.
The copyright in all images, illustrations and written material produced by or for Bettina Network, Inc. relating to a lot, including the contents of this sale, is, and shall remain at all times, the property of Bettina Network, Inc. and shall not be used by the purchaser, nor by anyone else, without our prior written consent.
These conditions of sale shall be governed by the laws of the state of Delaware (excluding the laws applicable to conflicts or choice of law). The buyer/bidder agrees that any suit for the enforcement of this agreement may be brought, and any action against Bettina Network, Inc. in connection with the transactions contemplated by this agreement shall be brought, in the courts of the state of Delaware or any federal court sitting therein. The bidder/buyer consents to the nonexclusive jurisdiction of such courts and waives objections that it may now or hereafter have to the venue of any such suit.
